Beneficiaries Named in the Will

Note: Please list all beneficiaries named in the will. If you are unsure of someone's current address or contact information, enter what you have and note "unknown" where needed. Our attorney will guide you through any gaps during your consultation.

Heirs of the Estate

Note: When there is no will, Texas law requires identifying all heirs. Please follow this order:
  1. Spouse — list the decedent's surviving spouse, if any.
  2. Children — list all children (biological and adopted), if any.
  3. If there is no spouse and no children — list the decedent's living parents, siblings, nieces, and nephews.
If you are unsure of someone's current address or contact information, enter what you have and note "unknown" where needed. Our attorney will guide you through any gaps during your consultation.

Assets of the Estate

Important — Probate Assets Only: This form collects probate assets — property that must pass through the court process. Please list only the following:
  • Home / Real Estate — only if there is no Transfer on Death Deed and no Lady Bird Deed on the property.
  • Financial Accounts — only accounts that have no named beneficiary. (The bank can confirm whether a beneficiary is on file.)
  • Personal Property — items with no title documents or beneficiary designations, such as household furnishings, jewelry, a baseball card collection, tools, artwork, etc. These can be grouped generically (e.g. "Household items," "Jewelry collection").
  • Vehicles — titled vehicles that have no transfer-on-death designation.
Do NOT list the following — these pass outside of probate and are not included:
  • Homes with a Transfer on Death Deed or Lady Bird Deed
  • Financial accounts that have a named beneficiary (the bank will tell you)
  • Titled vehicles with a transfer-on-death designation
